Terms and conditions of sale
The present general terms and conditions of sale are intended to govern orders and purchases made by the Internet user (hereinafter referred to as the "customer") from SARL GENERAL DIFF via its commercial Internet site www.generaldiff.com.
They are expressly accepted by the customer who places an order.
The site is the property of GENERAL DIFF in its entirety, as well as all related rights. Reproduction in whole or in part is prohibited without the prior authorization of the owner.
1. ACCEPTANCE OF CONDITIONS
The customer acknowledges having read, at the time of placing the order, the conditions of sale set out on this screen and expressly declares accepting them without reservation. The present general conditions of sale govern the contractual relations between GENERAL DIFF and its customer, both parties accepting them unreservedly. These conditions of sale shall prevail over any other conditions appearing in any other document, except in the event of prior, express and written derogation.
GENERAL DIFF may modify these terms and conditions at any time and without notice, the modifications then being applicable to all orders subsequent to the modification date.
2. TERMS AND CONDITIONS OF THE ORDER
To place an order, the customer must complete the following steps:
Select the items in the dedicated sections,
Choose the desired quantity for each item,
Add the chosen item(s) to the shopping cart,
Continue shopping or complete the order,
If the order is complete, go to the Shopping Cart and validate to access payment,
Enter your e-mail address or log in if an account has previously been created in the customer's name,
In the case of a new account or a change of situation, fill in and check under your sole responsibility the information relating to your full contact details (surname, first name, date of birth, postal address and e-mail address), delivery address and billing address,
Tick the box to accept the general terms and conditions of sale,
Choose the method of payment from those proposed,
Check and complete the order.
After validation of this last step, a confirmation appears on the screen and a summary of the order is sent by email. This computer validation is proof of the order by the customer. Payment of the purchase price is automatically made at the moment of this agreement.
Given the nature of GENERAL DIFF's business and the possibility of delays or failures in its supplies, GENERAL DIFF expressly reserves the right to cancel an order and consequently not to validate an order. The customer will be informed by any means within a reasonable time, and will be reimbursed without delay and at the latest within thirty days of payment of the sums he has paid.
In particular because of this option open to GENERAL DIFF to refuse an order due to unavailability, the non-execution or partial execution of an order shall not give rise to any right to compensation.
GENERAL DIFF also reserves the right to refuse an order from any customer with whom there is a dispute or disagreement concerning the payment of a previous order.
GENERAL DIFF's confirmation of availability and of its agreement to the order is carried out by an e-mail sent to the customer at the e-mail address that the latter will have communicated, this agreement by GENERAL DIFF alone enshrining the stipulation of the sale and thereby giving the delivery information.
3. PRODUCT DESCRIPTION
The essential characteristics of the product are indicated in the "product sheet", which generally contains several photos of the product and indicates its special features. The photographs illustrating the products, in support of the text, do not enter into the contractual field. The detailed product sheet is the only contractual source. However, in the event of manufacturers changing the technical composition of product references without prior notice, GENERAL DIFF cannot be held responsible, nor can the product be exchanged. GENERAL DIFF reserves the right at any time to update or improve its data sheets or to withdraw its products from sale. The customer may also contact GENERAL DIFF by telephone at 0142330528 or by e-mail at generaldiff@hotmail.com to obtain further information on the products presented via the Contact page of the website.
4. AVAILABILITY
Products are presented on the www.generaldiff.com website for information purposes only and, due to the need for frequent updating, are subject to stock availability.
5. RIGHT OF WITHDRAWAL
Generaldiff respects the legal cooling-off period of 14 calendar days. During this period, the consumer may return, at his or her own expense, the product or products that do not suit him or her. This period runs from the day after delivery of the consumer's order. All returns must be notified in advance to Generaldiff's Customer Service Department by e-mail: generaldiff@hotmail.com
Exceptions to the right of withdrawal : products cut from fabrics and ribbons, made-to-measure or exclusive products.
Generaldiff recommends that consumers return their products by colissimo with a recommendation or additional insurance guaranteeing, where appropriate, compensation for the products at their actual market value in the event of spoliation or loss of the goods.

The returned product must be undamaged: complete in its original packaging and condition.
This right of withdrawal is exercised without penalty, with the exception of the cost of return, which remains the responsibility of the consumer. The value of returned items "Exceptions to the right of withdrawal: cut, made-to-measure or exclusive products" will then be reimbursed by re-crediting the bank account (secure transaction) in the case of payment by credit card. With the customer's agreement, the value of the return may be credited back to the customer's account and deducted from subsequent orders.

6. PRICE
The prices indicated on the website are in euros, inclusive of all taxes and exclusive of delivery costs.
They are subject to change, particularly in the event of fluctuations in the customer's currency against the euro or changes in VAT rates.
These prices are only valid for purchases via the website and do not apply to purchases in the store.
This means that online prices may differ from those charged for in-store purchases.
The prices indicated on the website, by e-mail or during the various GENERAL DIFF advertising campaigns are given on an ad hoc basis and are subject to change, particularly in the event of a product update. Furthermore, the prices applied online may differ from those applied in store and are not opposable to sales made in store.
The price applicable to the customer's purchase on the website is that in force at the time of the order. The price appearing on the order validated by the customer is firm and definitive. If prices fall a few days after the order, GENERAL DIFF shall under no circumstances make any compensation for the difference. If prices increase after the order, GENERAL DIFF remains committed to delivering at the price fixed on the day of the order. Prices do not include postage and packing, which are automatically indicated at the time of the order on the order summary, before its validation and final registration.
7. VAT AND TAXES
For deliveries to mainland France, the items ordered are subject to French VAT.
Purchases involving delivery to French overseas departments and territories are exempt from VAT in mainland France. This exemption applies to the sale price of the products and the transport service. The complete service will be invoiced exclusive of VAT. However, upon arrival of the parcel, the purchaser is solely responsible for clearing the goods through customs, paying all duties and taxes due upon entry into the French department or territory.
For purchases involving delivery within the European Community, the items ordered are subject to French VAT. However, if the customer is a company and has an intra-Community VAT number, the invoice will be issued exclusive of VAT. In this case, please contact customer service directly. If the intra-Community VAT number does not exist, the order will be automatically cancelled and GENERAL DIFF will be released from all obligations.
For purchases involving delivery outside the European Community and the rest of the world, invoicing will also be exclusive of French VAT. In any case, it is the customer's sole responsibility to pay any import duties and taxes due in his or her own country, and to ensure in advance that the products ordered are authorized for import.
Some countries will charge customs duties and other taxes depending on the type and declared value of the product. GENERAL DIFF is not responsible for the correct payment of these charges by the customer.

8. METHOD OF PAYMENT
The price is payable in cash, without discount, and in Euro only. Payment is made in full on the day the order is placed by the Customer, by secure payment, in accordance with the following terms and conditions:
by credit card: Carte Bancaire, Visa, MasterCard, American Express, other credit cards.
Payment by credit card is irrevocable, except in the event of fraudulent use of the card. In this case, the customer may request the cancellation of the payment and the return of the corresponding sums.
Payment data is exchanged in encrypted mode using the Stripe protocol.
The price is expressed in Euro. The Customer's credit card will be debited in Euro.
In addition, the Vendor reserves the right, in the event of non-compliance with the above terms of payment, to suspend or cancel the delivery of current orders placed by the Customer.
The Customer shall not be charged any additional costs in excess of those incurred by the Vendor for the use of a means of payment.
9. TERMS OF DELIVERY AND TRANSPORT
Products are dispatched within 24-48 hours to the address indicated by the customer during the ordering process. Delivery is made by a third-party company, which is solely responsible for effective delivery. GENERAL DIFF nevertheless undertakes to deliver to the customer within a maximum of 30 days from the day on which the order is placed. Other lead times indicated on the website are given for information only and are average lead times usually observed. The company www.generaldiff.com cannot be held responsible for delivery times, which are beyond its control. All shipments are tracked. Delivery costs and times also depend on the country of destination, and are subject to change depending on the transport service provider's pricing options. Shipping charges are payable in full by the customer and are automatically calculated and added to the order amount according to the destination. Shipping costs, which depend on an external party, are not stated definitively at the time of ordering, but are given as an indication only. In the event of readjustment of shipping costs by the carrier, the customer will be liable for full payment of the resulting price differential, and GENERAL DIFF may request payment in order to release the order.

11. FORCE MAJEURE
Strikes, civil or foreign war, riots, acts of terrorism, total or partial destruction of premises or other, disturbances in transport, supply difficulties, customs measures of any nature or origin whatsoever, or any other fortuitous event which prevents or delays in whole or in part the performance of GENERAL DIFF's obligations are considered to be cases of force majeure, which release GENERAL DIFF from any obligation to perform.
12. JURISDICTION AND APPLICABLE LAW
The courts of Paris shall have exclusive jurisdiction over any disputes arising in any way whatsoever from these general terms and conditions and the contracts to which they apply. The applicable law is French law.
13. LEGAL INFORMATION
The personal information collected for the purposes of distance selling is compulsory, as this information is essential for the processing and dispatch of orders, and the preparation of invoices and warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act (Loi Informatique et Libertés), the processing of nominative customer data has been declared to the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés - CNIL). The customer has (article 34 of the law of January 6 1978) a right of access, modification, rectification and deletion of data concerning him/her, which he/she may exercise by contacting GENERAL DIFF. In addition, GENERAL DIFF undertakes not to communicate, free of charge or in exchange for payment, the contact details of its customers to a third party.
